These Terms of Service (“Terms”) govern your use of ScalePilot AI’s website, services, and AI-powered tools. By using our services, you agree to these Terms.

1. Services

ScalePilot AI provides marketing automation, AI chatbots, appointment booking, and related services (“Services”). Service details, scope, and pricing are defined in individual client agreements.

2. Eligibility

You must be at least 18 years old to use our Services.

3. Client Responsibilities

Clients are responsible for:

Providing accurate and lawful data for use in our systems.

Ensuring marketing practices comply with applicable laws (e.g., TCPA, CAN-SPAM, GDPR, CCPA).

Following all opt-in/opt-out compliance requirements when sending SMS/email campaigns.

4. Payments

Fees are specified in your Service Agreement or invoice.

Payments are due as agreed. Late or failed payments may result in service suspension.

5. Intellectual Property

All software, processes, and materials provided by ScalePilot AI remain our property. Clients are granted a limited license to use them during active service.

6. Data & Privacy

We handle data in accordance with our Privacy Policy. By using our Services, you consent to our data practices.

7. Termination

Either party may terminate services with written notice as outlined in the Service Agreement. Clients remain responsible for all fees incurred up to termination.

8. Limitation of Liability

To the maximum extent permitted by law, ScalePilot AI shall not be liable for indirect, incidental, or consequential damages. Our total liability is limited to the fees paid by the client in the three months prior to the claim.

9. Governing Law

These Terms are governed by the laws of Oregon. Any disputes shall be resolved in the courts of Oregon.

10. Changes

We may update these Terms at any time. Continued use of our Services constitutes acceptance of the updated Terms.
